These Terms & Conditions govern your use of our Website and Services. 

Throughout the site, the terms “we”, “us” and “our” refer to CryptOption NZ. The terms “you” and ‘your’’ refers to the user of our website. By accessing CryptOption NZ or purchasing products from this site, you agree to be bound by and comply with the following Terms & Conditions. We reserve the right to update, change or replace any part of these terms and conditions by posting updates and/or changes to our website. It is your responsibility to check this page occasionally for changes. Your continued use of or access to the website following any posted changes constitutes acceptance of those changes.

General Conditions

1. Products & Services 

We offer cryptocurrency-related hardware and non-crypto hardware accessories. 
- Availability: Products are subject to stock limits. All descriptions and pricing of products are subject to change at any time without notice, at the sole discretion of us. 
- Accuracy: Product details are provided in good faith but may occasionally contain errors. We reserve the right to correct any inaccuracies. Every effort is made to accurately display products but we cannot guarantee how your device may display any colour. 

2. User Responsibilities 

By accessing and using our website, you agree:  
- To provide true and accurate information when placing an order.
- Not to disrupt website functionality (hacking, spam, etc).
- Not to infringe on others’ intellectual property.  
- Not to use any item or product purchased from us for illegal activities.

3. Orders & Payments

We reserve the right, in our sole discretion, to accept, refuse, limit or cancel any order you place with us.
- Order Acceptance: In the event that a change is made such as suspected fraud, stock errors, etc, we may attempt to notify you by email or by any other contact details you have provided at the time the order was made.  
- Payment: Payment transactions are processed securely via the PayPal method. We do not store payment details.  
- Confirmation: Orders are binding once payment is validated. 

4. Pricing & Taxes

We reserve the right to change product pricing due to market fluctuations or supplier adjustments without notice.
- All prices are in NZD
- All prices are without NZ GST unless stated otherwise.

5. Shipping & Delivery

We use NZ Post Courier Services to ship locally within New Zealand and reserve the right to change the use of transport carriers at our discretion. We can ship internationally upon inquiry. Acceptance of international shipping costs must be confirmed by writing before an international order is dispatched.
- Ownership: Title of ownership transfers to the buyer when full payment is validated and the order is successfully dispatched.
- Delivery: Estimated delivery times are provided at checkout but are not guaranteed. We will work accordingly with the carrier if any issues arise pre-delivery.
- Risk/Loss: Responsibility of purchased product/s transfers to you upon delivery confirmation by the carrier. We are not liable for parcels lost, stolen or damaged after delivery confirmation. 

6. Returns, Refunds & Cancellations

We reserve the right, at our sole discretion, to approve or reject any request for a return, refund or cancellation. 
- Eligibility: Request up to 10 business days for Hardware Products and Non-Hardware Products after delivery with proof of purchase. Eligible and accepted returns for faulty or damaged items will be provided with remedial options.  
- Exclusions: Clearance items and any product used or damaged by user error are excluded eligibility for a return.
- Process: Initiate a return via [email protected]. Refunds are processed to the original payment method.

7. Privacy & Data

- Collection: We collect necessary personal and order data such as name and address, solely for order processing and legal compliance.  
- Retention: Data is stored only as long as required by New Zealand Law.  
- Third Parties: Payment processors handle transaction data; we never sell/share your data for marketing.  
- Security: Industry-standard measures protect your information detailed in our separate Privacy Policy.

8. Intellectual Property 

All content including logos, text, and images on Cryptoption.NZ is owned by us or licensed partners. Unauthorized reproduction/distribution is prohibited. Liability Limitations:
- Our products/services are provided "as is." We exclude all implied warranties to the extent permitted by NZ law.  
- Maximum liability is capped at the purchase price of the product/service.  
- We are not liable for indirect losses such as lost profits or data breaches unrelated to our negligence. 

9. Force Majeure

We are not liable for delays/failures caused by events beyond our control including natural disasters, strikes, pandemics or third-party service outages.

10. Indemnity

We may update these Terms & Conditions periodically. Changes take effect immediately upon posting and continued use of our website implies acceptance.

12. Termination

We may suspend/terminate access for violations of these Terms & Conditions.

13. Governing Law

These Terms & Conditions are governed by New Zealand law. Any disputes fall under the exclusive jurisdiction of New Zealand Courts.
